By accessing or using PulseChat ("Service"), operated by PulseChat ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
PulseChat provides an AI-powered sales chatbot that businesses embed on their websites to engage visitors, qualify leads, and facilitate meeting bookings. The chatbot uses artificial intelligence (specifically, large language models) to generate responses based on the customer's website content. PulseChat also provides aggregated, anonymized conversation intelligence analytics.
You acknowledge and agree that:
(a) The PulseChat chatbot is powered by artificial intelligence and is not a human agent. All conversations between website visitors and the chatbot are AI-generated.
(b) As a customer, you are responsible for ensuring that visitors to your website are informed that they are interacting with an AI chatbot, not a human representative. PulseChat displays an "AI Sales Assistant" label on the widget by default. You agree not to remove, hide, or obscure this disclosure.
(c) You agree to comply with all applicable laws regarding AI disclosure, including but not limited to the EU AI Act, California SB 1001, and any other relevant regulations in jurisdictions where your website operates.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the legal authority to bind your organization to these terms.
You may use PulseChat to engage website visitors, qualify leads, and capture contact information for legitimate business purposes. You may not use PulseChat to deceive visitors into believing they are communicating with a human, collect data for unlawful purposes, send spam or unsolicited communications through the platform, attempt to reverse-engineer the Service, or use the Service in violation of any applicable law.
PulseChat processes conversation data between your website visitors and the chatbot. This data includes chat messages, visitor-provided contact information (name, email, company), page URLs, and interaction metadata. Please refer to our Privacy Policy for full details on data collection, storage, and usage.
PulseChat aggregates and anonymizes conversation data across all customers to generate industry-level intelligence reports. By using the Service, you consent to your conversation data being included in aggregated, anonymized analysis. No individually identifiable visitor data or business-specific conversations are ever shared with other customers. You may opt out of contributing to aggregated intelligence by contacting us at hello@getpulsechat.chat.
Paid plans are billed monthly via Stripe. All fees are in US dollars and are non-refundable except as required by law. We offer a 14-day free trial for new accounts. You may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice.
We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for losses resulting from downtime, maintenance, or third-party service outages (including AI provider outages).
PulseChat and its original content, features, and functionality are owned by PulseChat and are protected by copyright, trademark, and other intellectual property laws. Your website content used to train the chatbot remains your property.
To the maximum extent permitted by law, PulseChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
We may suspend or terminate your account if you violate these terms. Upon termination, your chatbot widget will be deactivated and your data will be retained for 30 days before deletion, unless you request earlier deletion.
We may update these terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
